    • 6/20/2006 - Can Employers Summarily Dismiss Employees Charged, But Not Convicted, With A Criminal Offence?
      A recent Ontario decision considered the case of an employee charged with possession of child pornography. The employer quickly dismissed the employee for just cause and, in response, the employee sued for wrongful dismissal. The Court upheld the employer''s just cause defence. It concluded that, notwithstanding the fact that the employee had not yet been convicted, the nature of the employee''s conduct provided the employer with just cause for summary dismissal.
