Pushor Mitchell Lawyer Now Registered Trademark Agent


We are very pleased to announce that Vanessa DeDominicis has been accepted by the Canadian Intellectual Property Office as a Registered Trade-mark Agent and was officially entered on the list of Trade-mark Agents by the Registrar of Trade-marks on July 2nd 2008.
 
The role of a Trade-mark Agent includes the functions of preparing, filing and prosecuting applications for the registration of trade-marks; giving opinions on the registrability of trade-marks in accordance with criteria imposed by the law; conducting trade-mark availability searches to see whether a likelihood of confusion may exist between the trade-mark searched and the trade-marks of others; drafting appropriate responses to the Registrar of Trade-marks in the event that the Registrar disputes the registrability or availability of a trade-mark; and prosecuting opposition proceedings to defend a client's interests in a trade-mark by presenting appropriate evidence and argument to convince the Registrar that the subject trade-mark is registrable.

Further, a Trade-mark Agent is of vital assistance in advising and serving trade-mark owners in the maintenance and protection of their trade-marks. For example, if a trade-mark owner allows others to use their trade-marks or grants franchises, a Trade-mark Agent's advice is invaluable to ensure that use of the trade-marks is properly licensed to protect the distinctiveness and enforceability of the trade-marks. A Trade-mark Agent will also ensure that a registered trade-mark is kept in good standing with the Canadian Intellectual Property Office by filing any assignments to reflect change in ownership of the trade-mark and attending to renewal of trade-mark registrations which are granted for an initial 15 year period."
