Canadian Supreme Court Sets Standards For Online Contracts


My weekly Law Bytes column examines the recent Supreme Court of Canada decision involving Dell Computer, online contracting, and mandatory arbitration clauses. The court ruled that the arbitration clause was enforceable, despite the fact that it removed the ability for consumers to launch a class action suit. It also concluded that including a hyperlink to the terms and conditions in the contract was sufficient to form a binding contract.
